Agreement to Terms

By downloading, installing, or using Dayshift ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Dayshift is a personal development mobile application that guides users through a structured one-day "Reset Day" protocol for deep self-reflection and life planning. The App provides:

Three-Phase Methodology

• Morning Excavation (45-60 minutes): 22 carefully sequenced psychological questions designed to uncover limiting patterns, clarify your vision, and identify what you want to move toward or away from in life
• Pattern Interrupts (Throughout the day): 6-8 strategically timed notification prompts for ongoing reflection, with customizable scheduling
• Evening Synthesis (30-45 minutes): Review and consolidation of your insights into a "Life Game Board" - a personal strategic plan including vision statements, goals, missions, and daily actions

Important: Dayshift is designed as a self-guided personal development tool. It is not therapy, counseling, or medical treatment.

Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

Purchases and Payments

Dayshift offers the following pricing options:

• Single Reset: 14.99 EUR - Access for one complete Reset Day
• Annual Access: 49.99 EUR - Unlimited Reset Days for one year
• Lifetime Access: 149 EUR - Unlimited Reset Days forever

By making a purchase, you agree that:

• All purchases are processed through the Apple App Store or Google Play Store
• Refund requests must be submitted through your respective app store according to their refund policies
• All purchases are final and non-refundable through Dayshift directly, except as required by applicable law
• Prices are subject to change without notice, but existing purchases are honored
• Annual subscriptions auto-renew unless canceled at least 24 hours before renewal

User Content

You retain ownership of all content you create in the App ("User Content"). By using the App, you grant us a limited license to:

• Store and process your User Content to provide the service
• Use anonymized, aggregated data to improve the App

You are solely responsible for your User Content. Do not enter content that is illegal, harmful, or infringes on others' rights.

AI Features and Limitations

The App includes AI-enhanced features. You acknowledge and agree that:

• AI-generated content is provided for informational and reflective purposes only
• AI responses may not always be accurate, appropriate, or relevant to your specific situation
• You should not rely on AI content as professional advice, therapy, or medical guidance
• We do not guarantee the quality, accuracy, or usefulness of AI-generated content
• You use AI features at your own discretion and risk

Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse engineer or hack the App
• Share your account with others
• Use the App to harm, harass, or defraud others
• Interfere with the App's operation or security
• Scrape or collect data from the App

Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by Dayshift and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYSHIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.

Account Termination

You may delete your account at any time through Settings > Data & Privacy > Delete All Data in the App. When you delete your account, all your data is immediately deleted from your device and removed from our servers within 30 days.

We reserve the right to suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or use the App for illegal purposes.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App. Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
